Welcome to Askurch Pharmacy ("Askurch," "we," "us," or "our"). These Terms of Service govern your access to and use of the Askurch Pharmacy website, mobile application, and related services, including online medication ordering, doctor consultations, vaccination bookings, lab tests, home care, and subscription plans. By accessing or using our Services, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.
To use our Services, you must be at least 18 years old (or use the Services under the supervision of a parent or legal guardian), be legally capable of entering into a binding contract, and provide accurate, current, and complete information when creating an account or placing an order. We reserve the right to refuse service, suspend, or terminate accounts that violate these Terms or applicable law.
Askurch Pharmacy provides online pharmacy sales of prescription and OTC medications, doctor consultations, vaccination services, home care, lab test bookings, medication refills and subscription plans, and a partner pharmacy program. We act as a facilitator connecting you with licensed pharmacists, healthcare professionals, and, where applicable, verified partner pharmacies and laboratories.
Prescription-only medicines will only be dispensed upon presentation of a valid prescription issued by a licensed medical practitioner. You are responsible for ensuring that any prescription or medical information you upload is accurate, current, and genuine. Submitting a fraudulent, altered, or invalid prescription is strictly prohibited and may result in account termination. Our pharmacists reserve the right to verify prescriptions and to refuse to dispense a medication if there are concerns about authenticity, dosage, drug interactions, or patient safety.
All medications sold through Askurch Pharmacy are sourced from licensed, verified distributors and are registered with the National Agency for Food and Drug Administration and Control (NAFDAC) where required. We do not knowingly sell counterfeit, expired, or unregistered products. If you believe you have received a product that does not meet these standards, contact us immediately so we can investigate.
The information, consultations, and content provided through our Services are intended to support, not replace, professional medical judgment and the advice of your own treating physician. Doctor consultations do not constitute a diagnosis or complete medical evaluation and should not be relied upon in emergencies. If you are experiencing a medical emergency, call your local emergency services or go to the nearest hospital immediately. Healthcare professionals accessible through Askurch are independently licensed; Askurch does not itself practice medicine or pharmacy.
You are responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use of your account. You agree to provide accurate personal, medical, and payment information, and to keep it up to date.
All prices displayed on the platform are in Nigerian Naira (₦) unless otherwise stated and are subject to change without prior notice. Payment must be made in full at the time of ordering. We reserve the right to cancel or refuse any order due to product unavailability, pricing errors, suspected fraud, or unmet prescription requirements. Subscription plans will auto-renew and auto-charge at the applicable interval unless cancelled prior to the renewal date via your account settings.
We offer delivery within Lagos and Abuja, including same-day options where available, and nationwide shipping to other locations within Nigeria. Estimated delivery times are provided for guidance only and are not guaranteed. You are responsible for ensuring someone is available to receive time- or temperature-sensitive medications at the specified delivery address and time window. Risk of loss and title for products pass to you upon delivery.
For safety and regulatory reasons, medications generally cannot be returned once dispensed, opened, or delivered. If you receive a damaged, incorrect, expired, or otherwise defective item, contact us within the stated window for a replacement or refund. Consultations, vaccinations, and lab test appointments cancelled with insufficient notice may be subject to a cancellation fee.
You agree not to use the Services for any unlawful purpose, including attempting to obtain controlled substances without a valid prescription; submit false or fraudulent information, including forged prescriptions; interfere with the security or performance of the platform; or impersonate another person. We reserve the right to suspend or terminate accounts, and to report suspected unlawful activity to the appropriate regulatory or law enforcement authorities.
Where products or services are fulfilled by a partner pharmacy, laboratory, or independent healthcare provider listed on our platform, that party is independently responsible for the accuracy, quality, and legality of what they provide. Askurch makes reasonable efforts to vet partners but does not guarantee the actions or omissions of independent third parties.
All content on the Askurch Pharmacy platform, including logos, text, graphics, software, and design, is the property of Askurch Pharmacy or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without prior written permission.
To the fullest extent permitted by law, Askurch Pharmacy shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability for any claim shall not exceed the amount you paid for the specific order or service giving rise to the claim. We are not liable for delays or failures resulting from circumstances beyond our reasonable control. Nothing in these Terms limits liability that cannot be excluded under applicable Nigerian law.
You agree to indemnify and hold harmless Askurch Pharmacy, its officers, employees, and partners from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms, misuse of the Services, or violation of any law or third-party right.
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal and medical information in accordance with the Nigeria Data Protection Act (NDPA) 2023 and other applicable data protection laws.
We may suspend or terminate your access to the Services at our discretion, with or without notice, if you violate these Terms, engage in fraudulent or unlawful activity, or for any other reason permitted by law. You may close your account at any time by contacting us.
We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. We will post the updated Terms with a revised "Last Updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or your use of the Services shall first be addressed through good-faith negotiation, and if unresolved, shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
